This Data Processing Agreement (“DPA”) is entered into between Pink Helper LLC (“Company,” “we,” “us,” or “our”) and all users, including clients, contractors, and other data subjects (“you” or “your”), to govern the processing of personal data in compliance with applicable data protection regulations such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

1. Definitions

• Controller: Pink Helper LLC, which determines the purposes and means of processing personal data.

• Processor: Third-party service providers that process personal data on our behalf, such as Stripe and Google.

• Full name, email address, phone number.

• Payment details (processed securely via Stripe).

• To analyze platform usage and improve functionality.

• To comply with legal and regulatory requirements.

3. Obligations of Pink Helper LLC

• Lawful Processing: We process personal data in accordance with GDPR, CCPA, and other applicable laws.

• Security Measures: We implement appropriate technical and organizational measures to protect personal data from unauthorized access, loss, or destruction.

• Data Transfers: If personal data is transferred outside of the European Economic Area (EEA) or California, we ensure such transfers comply with applicable legal requirements (e.g., Standard Contractual Clauses or adequacy decisions).

4. Third-Party Processors

• Authorized Processors: Pink Helper LLC uses third-party processors, such as:

• Processor Obligations: Third-party processors are required to:

• Notification: In the event of a data breach involving your personal data, we will notify affected parties within 72 hours and take appropriate remediation steps.

• Support: We will provide support to ensure your rights are protected.

8. Liability

• Pink Helper LLC is not responsible for data breaches caused by third-party processors acting outside of our instructions or by actions taken by users.

9. Updates to this Agreement

We may update this DPA to reflect changes in legal requirements or our business operations. Updates will be posted on our website with a new “Last Updated” date.
